Terms of Service

By accessing or using USCIS-Wand (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Shopper's Spot LLC, a Texas Limited Liability Company (EIN: 92-3650188) ("we," "us," "our," or "USCIS-Wand"), the operating entity and solely liable party for the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

USCIS-Wand is a premium immigration case management platform that provides the following services:

• USCIS case status tracking using official receipt numbers via the USCIS Case Status API.
• AI-powered immigration guidance, visa recommendations, and case explanations.
• Document management and organization with a secure Document Vault.
• Application history tracking and timeline management.
• Appointment reminders and USCIS office locator.
• SMS and email notifications for case status changes.
• Subscription-based premium membership plans (Plus and Family tiers).

We are an independent service provider and are not affiliated with, endorsed by, or sponsored by USCIS or any U.S. government agency.

To use certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your account credentials and password.
• Be responsible for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.
• Be at least 13 years of age to create an account.
• Provide truthful information, as providing false information may result in account termination.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
• Submit false, misleading, or fraudulent USCIS receipt numbers or immigration information.
• Attempt to gain unauthorized access to our systems, user accounts, or the USCIS API.
• Use the Service to provide immigration legal advice to others unless you are a licensed attorney.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Scrape, data mine, or systematically extract data from the Service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use the Service to transmit viruses, malware, or any other malicious code.
• Share your account credentials with others or allow multiple users to access a single account.

Plans: We offer subscription plans including Plus (monthly/annual) and Family (monthly/annual). Pricing and features are displayed on our Subscription page.

Billing: Subscriptions are billed through Stripe. Monthly plans are billed upfront with no trial period. Annual plans include a 7-day free trial where applicable.

Auto-Renewal: Subscriptions auto-renew by default. You may turn off auto-renewal at any time in your Profile settings or via the Stripe billing portal. Cancellation takes effect at the end of the current billing period.

Refunds: Refunds are handled on a case-by-case basis. If you believe you were charged in error, contact us at support@usciswand.com within 14 days of the charge.

Price Changes: We may change subscription prices with at least 30 days' notice before the new pricing takes effect.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, button icons, software, and data compilations — are the exclusive property of USCIS-Wand and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent.

User content (documents, notes, case data) remains your property. By uploading content, you grant us a limited license to process and display it solely to provide the Service to you.

Not Legal Advice: The Service provides informational content and AI-generated guidance for general immigration purposes only. Nothing in the Service constitutes legal advice, and USCIS-Wand is not a law firm. AI-generated responses may be incomplete or inaccurate. Always consult a licensed immigration attorney for your specific situation.

Not a Government Agency: USCIS-Wand is not affiliated with USCIS or any government agency. Case status data is retrieved from the official USCIS Case Status API, but we do not control the accuracy or timeliness of that data.

No Guarantee: We do not guarantee any specific outcome for your immigration case. Case approval, processing times, and decisions are made solely by USCIS.

As-Is: The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

To the fullest extent permitted by law, Shopper's Spot LLC (operator of USCIS-Wand) and its officers, members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of data or documents stored in the Service.
• Delays, errors, or inaccuracies in USCIS case status data.
• Decisions made based on AI-generated guidance.
• Service interruptions, outages, or unauthorized access to your account.
• Any action or inaction taken based on information from the Service.

The total liability of Shopper's Spot LLC for any claim arising from the Service shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

You agree to indemnify and hold harmless Shopper's Spot LLC (operator of USCIS-Wand) and its officers, members, managers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

By You: You may delete your account at any time through your Profile settings. Upon deletion, your personal data will be permanently removed within 30 days as described in our Privacy Policy.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service. We may also terminate accounts that remain inactive for extended periods.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. The operating entity and liable party, Shopper's Spot LLC, is a Texas Limited Liability Company. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Houston, Texas. You waive your right to participate in a class action lawsuit or class-wide arbitration.

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. For significant changes, we will also send a notification to your registered email address. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
